The LIA is encouraging anyone who can to attend the City Council Hearing on Wednesday, May 7 at 5pm. The council will be discussing Group Home Bill 07-002. If this bill is passed it would remove a requirement that community input be taken when any more than four unrelated individuals are to be housed in a single-family home. It would allow a single-family home to house up to 15 unrelated individuals with not only no input from the neighborhood, but no notification of which houses are being occupied in this way. The proposed Zoning change would allow the density of group homes of all kinds (including student housing) to go up to 15 persons per home with no oversight by the neighboring residents. When you look at the data on how much space the average American lives in - 1800 sq. feet, 2.6 per household (2000 census) - having up to 15 persons per household crams the disabled clients into only 17% of the amount of space that the average US resident lives in. The idea that this is healthy and safe is driven by the promise of profit to the operators of these group homes. State regulation and enforcement of existing homes is already severely lacking.

Opposition to this bill is as much in the interests of the disabled, elderly and recovering clients of these homes as it is in the interest of the surrounding community.

The hearing takes place in Council Chambers which is located in the DuBurns Council Chamber on the 4th floor of City Hall. Whether or not you are able to attend, please contact your councilperson and ask them to oppose this misguided piece of legislation. Many councilmembers are under the impression (being put forth by the business interests which would benefit from the ability to set up more group homes - which are BUSINESSES) that current zoning regulations violate the Americans with Disabilities Act. The council members are being told they need to change this zoning law in order to avoid potential litigation on behalf of persons with disabilities. But a recent U.S. Court of Appeals ruling concluded that this area of law is still highly contested. The consequences of changing this zoning law now are much more real and dire than the consequences of waiting for a definitive answer from the courts.
